Dear County Executive Day, 

Thank you for your response to the question about renting out a backyard pool. Only part of the question by SWQ was addressed, though. Can you please clarify if there are any limits on friends’ and family’s use of one’s backyard pool?

Dear SSWQ, 

If the pool is only being used by "friends and family" it does not require a permit under state code, and there is no limit, that I am aware of, for the number of visitors.  Pools that are being rented in any way are not considered to fall under the "friends and family" exception.  As you can imagine, distinguishing renters from friends and family is one of our challenges with enforcement.
