Judge Upholds Term Limits In Town of Clarkstown

Rockland County Supreme Court Justice Amy Puerto ruled that the Town of Clarkstown's January vote to repeal its term limits law was illegal.

In the suit previously reported by Rockland Daily here, the judge ruled  on Friday that the January 4th local law repealing term limits by a 3 to 2 vote was "illegal, invalid, null, and void." 

Last winter, as reported here by Rockland Daily here, Town Supervisor George Hoehmann, Councilman Don Franchino, and resident Thomas Foley sued to invalidate the Town's term limits adopted in 2014. The term limits prevented an elected official, including Hoehmann, from serving more than eight consecutive years in the same office.

The judge also confirmed her earlier ruling that the Town of Clarktown can only repeal the term limits law by a "supermajority" of four council votes.
